Liability insurance requirements - Invasive medical products

Hello, MAPPers--

Over the years, our company has produced plastic parts for a variety of medical products for external use. However, we've recently been asked to quote components that are to be used in invasive surgical procedures.

Our insurance agent is recommending that we go through a broker to purchase our own policy to ensure liability coverage for these new products. She says it is not enough to be named an additional insured on the manufacturer's (our customer's) policy.

Does anyone have some experience navigating this area which they'd be willing to share?

Hello Rich,

Responding because we are in a somewhat similar situation this year, and hoping like you to get some feedback from MAPP members. Although we have been doing molded components for invasive medical products for years, only this year has our liability carrier raised issues with any invasive medical and declined to cover it. Our prior experience was that parts for implantables and life-sustaining things like pacemakers were considered riskier and split off to more expensive "surplus lines" policies, but this is the first time our carrier has raised similar concern about all invasive products. Our insurance agent is saying the carriers are blaming out-of-control legal defense costs as well as poor investment returns for the harder attitude on this. As I post this we have not yet resolved the issue.

Sorry I could not suggest a solution, but I wanted to join you in asking: any medical molders or component suppliers out there who can share insights on how they handle product liability for invasive medical? Thank you.

Jumping onto this link to see if anyone carries product liability on custom molded parts - even on product that is not invasive? Or a "completed operations" policy? Thanks for the help!
